January Visa Bulletin The Department of State has released the January Visa Bulletin. Most categories moved only a month forward at best except EB2
India which retrogressed even further back to January 1, 2000! A note on the bulletin states gives further indication that EB2 India will retrogress further, possibly becoming unavailable for most of Fiscal Year 2008 (See Note D). For full visa bulletin see: http://travel.state.gov/visa/frvi/bulletin/bulletin_3897.html Employer Wants to Hire US Workers The Tampa Tribune recently published an article entitled “He Wants to Hire US Workers” retelling the story of Tom Beckwith, chief executive of Largo-based Beckwith Electric Co. Beckwith states that this summer he had to reluctantly offshore services to a company in India since he was not able to find the expertise in the US that he needed. Having hired up to seven H-1B employees in the past, Beckwith has been unable to win any H-1B visas the past two years under the H-1B cap, thereby leaving him no option but to offshore services. Although the costs involved for offshoring are significantly cheaper, Beckwith comments India is “a long way away, it takes a lot of coordination and I’d rather have it done in the U.S.” http://www.tbo.com/news/money/MGBQQ9SR1AF.html
Call For Action While we are still a few months away from the Fiscal Year 2009 H-1B cap opening up, we are continuing our efforts to exert pressure on Congress to alleviate the H-1B situation. Only with repeated, constant contact will our representatives in Congress be reminded of the need of talented workers from abroad. The lobbying coalition, Compete America [http://www.competeamerica.org] has prepared a persuasive letter to Congress that explains the impact of the H-1B crisis. We at HLG are encouraging our clients to send this letter to your US Senators and Congressmen asking for action to be taken raising the cap numbers or eliminating the cap altogether. The announcement was officially made by the Department of State on December 14, 2007. New I-9 Form Must Be Used Starting December 26th Starting December 26th, 2007, employers are required to use the new I-9 Form for all new hires and for reverification purposes. As a reminder, the Immigration Reform and Control Act requires all U.S. employers to verify the employment eligibility and identity of all employees within the first three days of employment, by completing Form I-9, Employment Eligibility Form. USCIS Considering Comments to Replacing Green Cards Currently the USCIS is reviewing 298 comments submitted during the public comment period for the proposition to replace permanent residency cards issued without an expiration date. The proposed rule does not invalidate these permanent residency cards. Permanent Residents who currently hold these cards may continue to use them when seeking employment, traveling, and in other situations where proof of status is required. H-2Bs Remain Available for Fiscal Year 2008 As of December 10, 2007, the USCIS has received 13,434 H-2B petitions. This is more than 1/3 the amount allocated for the second half of the fiscal year 2008 (i.e. 33,000). H-2B visas are used by employers to hire seasonal or intermittent temporary workers. Typically, H-2B workers fill labor needs in the construction, health care, landscaping, lumber, manufacturing, food service/processing, and resort/hospitality service industries. http://www.uscis.gov/portal/site/uscis/
