12/13/2006 IMMIGRATION ALERT
CHANGE IN PREMIUM PROCESSING

In a change that frankly makes very little sense, AILA is reporting that the USCIS will now require Petitioners (generally corporate sponsors) to personally sign the I-907, Request for Premium Processing Service. Presently, attorneys may sign on behalf of their Petitioner-clients. USCIS failed to provide any reason for the change -- for instance abuse of process by past actors. This change is surprising because HLG finds the Premium Processing division to generally be less overtly bureaucratic than other USCIS divisions.

The AILA Notice also indicates that USCIS will allow attorneys to sign on their Petitioner-clients' behalf as an alternative approach with one caveat: if attorneys sign for their Petitioner-clients, the attorney must include a Power of Attorney signed by the Petitioner-client. Since it is just as easy to get the Petitioner-client to sign the Form I-907 itself, HLG does not believe that this option will be used very often.
