11/26/2003 HEALTHCARE IMMIGRATION ALERT:
VISASCREEN NOT REQUIRED AT THE TIME OF FILING AN I-485


The CIS (formerly the “INS”) has issued a statement saying the healthcare certification (often referred to as “VisaScreen”) is not required at the time of filing an adjustment application but can be submitted at anytime during the adjustment application. For years, the USCIS has allowed healthcare workers to file an I-485 adjustment application and submit the healthcare certification (“VisaScreen”) at the time a Request for Evidence is issued. However, this policy seemed to change when Mr. William Yates, Associate Director of Operations at CIS, issued a September 22, 2003 memo that said the healthcare certification is required at the time of filing.

After further review, Mr. Yates has clarified the memo and has said that the long-standing policy of allowing the healthcare certificate to be submitted post filing will remain in effect.
