08/06/2004 HEALTHCARE IMMIGRATION ALERT:
DS 230 SHOULD NOT BE SENT WITH I-140s
 

During a recent phone conference between AILA and CIS Service Operations, AILA representatives requested CIS to expedite Schedule A I-140 cases. CIS said they would review whether it is feasible for them to expedite nursing cases but suggested that employers file DS 230s in a sealed envelope along with their I-140 Petitions and CIS would forward the DS-230 to NVC with the approved I-140. CIS opined that this would expedite the process at the National Visa Center (NVC).

Hammond Law Group contacted NVC to see if they would follow this procedure. NVC's response was that attorneys should NOT follow the procedure suggested by CIS. The NVC's email to Hammond Law Group said:

The NVC is not encouraging attorneys seeking to expedite Schedule A I-140 nurse petitions to enclose a sealed envelope with all necessary documents and fees along with the I-140 petition...... Do not send any forms or fees to the NVC prior to their request by the NVC. Thank you for bringing this issue to our attention. We will work with CIS to ensure that this misunderstanding is clarified with the other attorneys attending the June 21, 2004 Service Center Operations Teleconference.
