6/9/2006 IMMIGRATION ALERT:
USCIS BACK AND FORTH ON VISASCREEN INTERPRETATION

Last week a message posted on AILA's News service implied that the USCIS no longer would allow I-140/485 nurse and Physical Therapist filings unless those cases contained the Healthcare Certificate (e.g. Visa Screen) at the time of filing. Current practice is that the Healthcare Certificate may be inter-filed at the time of the Request for Evidence (RFE). Long-time petitioners will remember that the USCIS tried this back in 2003. Fortunately, the USCIS has rescinded that News Item. The current practice remains in effect: I-140/485 cases may be filed without the Healthcare Certificate. When the RFE is issued, the Healthcare Certificate may be inter-filed.
