IMMIGRATION ALERT
A report has surfaced that the CIS has
filed an interim regulation that would allow it to issue "duration of
adjustment" Employment Authorization Documents (EADs) . The duration of
adjustment EADs would be valid as long as an Applicant has an I-485,
Adjustment of Status pending with CIS. Apparently the regulation has
cleared the Department of Homeland Security (DHS) and has been sent to the
Office of Management and Budget (OMB) for approval. OMB generally has 90
days to review a regulation and either reject it or clear it for
publication in the Federal Register. Shortly thereafter the regulation is
effective. Unfortunately, the rule does not appear to address Advance
Paroles.
