INS FILING FEE INCREASE


Effective February 27, 2003, the INS has readjusted the fee schedule to restore filing fees to their original rate. Since January 24, 2003, the INS has accepted a reduced rate on filing fees in order to comply with the Homeland Security Act of 2002 in which Congress required the INS to eliminate the surcharge on filing fees for asylum and refugee services. However, on February 20, 2003, President George W. Bush signed the Omnibus Budget Bill, which deleted the fee provision in the Homeland Security Act of 2002.

The INS' filing fees have returned to their pre-January 24 level. For instance, an I-129 petition will now need to include a filing fee of $130.
The INS will accept the reduced fee for petitions postmarked or received at the INS on February 27, 2003 but anything postmarked after February 27, 2003 will require the adjusted fee.
