FACTORS TO CONSIDER
IN DETERMINING WHETHER A
FOREIGN NATIONAL QUALIFIES FOR A NATIONAL INTEREST WAIVER
The following list is a composite
of possible factors which may indicate that a national interest
waiver is the best approach for applying for a permanent residency
green card. It is important to note that the list is a compilation
of several factors which have been successfully used in the past
to support a national interest waiver application. Under the new
In Re New York State Department of Transportation standards,
they may no longer be applicable.
- Evidence that the foreign national
can increase the U.S.'s global competitiveness
- Evidence that the foreign national
can create U.S. jobs through innovative corporate planning
- Letters from corporate executive
officers confirming the foreign national's business expertise
and how (s)he assisted in improving performance within the company
and strengthening the company's competitive position
- Letters from corporate executive
officers confirming the saving of jobs in certain areas
- Letters from corporate executive
officers demonstrating that the foreign national is needed to
turn a business entity around
- Letters from prospective business
customers confirming the future purchase of products
- Evidence that the foreign national
was hired by a company to preserve jobs
- Evidence that the foreign national's
ability in a specific area of business management
- Evidence that the foreign national
can stimulate growth in the U.S.'s telecommunications structure
- Evidence that the foreign national
as a record of promoting U.S. exports and international trade
- Evidence that the foreign national
is the owner of a small business which competes with larger businesses
- Evidence that the foreign national
is self-employed or otherwise employed in a position that is
not amenable to the traditional labor certification process
- Evidence that the foreign national
will make significant contribution to cultural or athletic life
- Evidence that there is a shortage
of physicians in the area where the foreign national will work
- A Health and Human Services
report confirming the lack of medical supplies in the area where
the foreign national will work
- Evidence that the foreign national
not only is making a significant contribution in high level medical
research, but that (s)he is from a country where political and
economic conditions make it impossible for the foreign national
to continue to contribute to world and public health
- General evidence that the foreign
national is recognized as an expert from peers and government
officials
- An extract from a Presidential
speech emphasizing the foreign national's importance to the U.S.
- A recommendation form a U.S.
Congressman
- A recommendation from a U.S.
Governor
- Letter from Director of Economic
Development confirming the importance of the foreign national's
work
- Letters of support from leaders
within academia
- Evidence that the foreign national
is a member of professional associations
- A Time magazine article mentioning
the foreign national's work
- Evidence that the foreign national
has authored numerous papers, publications, etc.
- Evidence that the foreign national
has had many articles published about the person's expertise
- Evidence that the foreign national
has been internationally recognized
- Evidence that the foreign national
has obtained his/her Ph.D. degree
- Evidence that the foreign national
has spoken, lectured, or taught on the academic level in many
places around the world
- Evidence of the foreign national's
past successes in his/her field of endeavor
- Evidence that the foreign national
has participated in a large research project
- Evidence that the foreign national
has a unique set of expertise and experience
